Terms of Service

These Terms govern your use of PocketPOS ("the Service"), operated by PocketLab ("PocketLab", "we", "us"). By creating an account or using the Service, you ("you", "the merchant") agree to these Terms.

1. The Service

PocketPOS is a mobile-first point-of-sale, online storefront, and shop-management tool provided as software-as-a-service. We may add, change, or remove features over time.

2. Your account

You are responsible for the accuracy of your account information, for keeping your login secure, and for all activity by the staff accounts you create. You must be authorised to operate the business you register.

3. Acceptable use

You agree to use the Service lawfully and not to misuse it, interfere with its operation, or use it to sell prohibited goods or to process unlawful transactions. You are solely responsible for your products, your sales, your prices and taxes, and your dealings with your customers.

4. Plans & billing

• New accounts start with a 7-day free trial — no card needed. After the trial, continued use requires a paid plan.
• Paid plans (Pro, Grow, Prime) are billed in advance, monthly or annually, in Malaysian Ringgit, via our payment provider. Annual is billed as 10 months (≈2 months free).
• We do not store your card. A renewal or upgrade requires your action each time — there is no silent auto-charge.
• You may cancel a paid plan at any time; access continues until the end of the period you've paid for. See our Refund & Cancellation policy.
• Prices and plan contents may change; we'll give reasonable notice and changes won't affect a period you've already paid for.

5. Payments you take from your customers

When you connect your own payment account (e.g. ToyyibPay / DuitNow QR / FPX), payments from your customers flow directly between you and your customer through your own account. PocketPOS is not a payment processor, bank, or money-services business, and does not hold, settle, or have access to those funds. Gateway and transaction fees are charged by your payment provider under your agreement with them. Any fee, settlement, or payout figures shown in the app are estimates for your convenience and are not guarantees.

6. Your data & content

Your shop data and content remain yours. You grant us the limited rights needed to host and operate the Service for you. Our handling of personal data is described in our Privacy Policy.

7. Intellectual property & third-party marks

"PocketPOS", "PocketLab", and our logos are our marks. Third-party names such as DuitNow, FPX, ToyyibPay, and WhatsApp belong to their respective owners and are referenced only to describe compatibility — no partnership or endorsement is implied.

8. Availability & "as is"

We work hard to keep the Service available but provide it "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not guarantee uninterrupted or error-free operation. Keep your own records of important data.

9. Limitation of liability

To the maximum extent permitted by law, PocketLab is not liable for indirect, incidental, or consequential losses, or for lost profits, sales, goodwill, or data. Our total liability for any claim is limited to the fees you paid us for the Service in the three (3) months before the claim.

10. Suspension & termination

We may suspend or terminate access for breach of these Terms or unlawful use. You may stop using the Service and close your account at any time.

11. Changes to these Terms

We may update these Terms; the "last updated" date will change and material changes will be communicated. Continued use after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the Malaysian courts.
